If you design your own board (arduino base) It's legal to use the vendor id (VID) and product id (PID), which is 0x2341 and 0x0001 in case of UNO.

I am not a lawyer, but I believe that if you are selling a board with USB interface and with a firmware inside (so, when you plug your device in to USB port, it identifies itself) you probably should have your own VID.
